Terms of Service

The terms that apply when you use MagicInterview on the web, iPhone, iPad, Android or Mac, including accounts, Pro, acceptable use and liability.

These terms are an agreement between you and Agents AI Ltd. ("MagicInterview", "we", "us"), the operator of MagicInterview. They apply when you use the MagicInterview website, web app and apps for iPhone, iPad, Android and Mac (together, the "Service"). By creating an account or using the Service you agree to them. If you do not agree, do not use the Service.

These terms are not legal advice. Read them together with the Privacy Policy, the Acceptable Use Policy and, if you buy Pro, the Subscription Terms.

What MagicInterview is#

MagicInterview is a live conversation copilot. It listens, with your permission, to an interview, meeting or sales call, and suggests words to say next, grounded in the sources you add. It can also help you practice out loud with an AI interviewer and research the other party on the public web. It does not join calls, does not speak for you, and does not make decisions on your behalf.

Suggestions are generated by AI models and can be wrong, incomplete or out of date. You are responsible for what you say and do. Check facts, figures and claims about yourself before you repeat them, and do not rely on MagicInterview for legal, medical, financial or other professional advice.

Who can use it#

You must be at least 16 years old and able to form a binding agreement. If you use MagicInterview on behalf of an organization, you confirm that you have authority to accept these terms for it.

Your account#

You create an account with your name, email address and a password. Give accurate information, keep your password private and tell us promptly at support@magicinterview.app if you think someone else has accessed your account. You are responsible for activity under your account. One account is for one person.

You can delete your account at any time in Settings. See the Privacy Policy for what deletion removes.

Your content#

Your projects, conversations, notes, sources, files and voice sample ("Your Content") belong to you. You give us a limited, worldwide, non-exclusive licence to host, process and transmit Your Content only to operate the Service for you: to store it, sync it between your devices, send it to the providers named in the Subprocessors list to produce the results you ask for, and keep the Service secure. We do not use Your Content to train models and we do not sell it.

You confirm that you have the right to add Your Content and to have it processed in this way, including any recording or transcript of other people. Do not add content that is unlawful, infringes someone else's rights, or includes information you are not allowed to share, such as another party's confidential material that you are bound to protect.

Acceptable use#

You must use MagicInterview lawfully, honestly and with respect for other people. In particular, you are responsible for knowing and following the rules of the place where you use it, including consent to recording or transcription and the rules of an interview, exam or employer. The Acceptable Use Policy sets out what is not allowed. We may suspend or end access if it is broken.

MagicInterview Pro and billing#

Some features, such as live coaching, cloud speech recognition, practice with AI voices and Research Online, need MagicInterview Pro. Pro is bought in the MagicInterview app (today the Android app; the iPhone, iPad and Mac apps are in App Store review), billed and refunded by the Apple App Store or Google Play, and unlocks the web app on the same account. The details, including renewal and cancellation, are in the Subscription Terms.

Third-party services and stores#

The Service depends on providers such as the Apple App Store, Google Play, your browser and operating system, and the providers on the Subprocessors page. Their own terms apply to your use of them. We are not responsible for services we do not operate.

If you use the iPhone, iPad or Mac app, you also accept Apple's standard Licensed Application End User License Agreement, and Apple and its subsidiaries are third-party beneficiaries of these terms for that app. If you use the Android app, Google Play's terms also apply. In both cases, any questions or claims about the app are for us, not for Apple or Google.

Availability and changes#

We work to keep the Service available, but it relies on internet connections, devices and third-party providers, so we cannot promise that it will always be uninterrupted or error-free. We may change, add or remove features, and we may update models and providers. If we make a change that significantly reduces what you paid for, we will tell you in advance where we can.

Our property#

MagicInterview, its software, design, name and logo belong to us and our licensors. We give you a personal, non-exclusive, non-transferable right to use the Service under these terms. You may not copy, modify, reverse engineer, resell or build a competing service from it, except where the law gives you that right regardless. Our name and logo may be used as described in the Brand Guidelines.

If you send us feedback or ideas, we may use them without obligation to you.

Ending the agreement#

You can stop using the Service at any time and delete your account. Cancelling a Pro subscription is done in the store you bought it in. We may suspend or end your access if you materially break these terms or the Acceptable Use Policy, if the law requires, or if we stop offering the Service. If we end your access without a breach by you, and you have paid for a period you can no longer use, we will help you obtain a refund of the unused part through the store, in line with the Subscription Terms.

Disclaimers#

The Service is provided "as is" and "as available". To the extent the law permits, we make no promise that MagicInterview will meet your needs, that its suggestions will be accurate, or that it will lead to a particular result such as a job offer, a sale or a successful meeting.

Nothing in these terms limits rights you have as a consumer that the law does not allow to be limited.

Limit of liability#

To the extent the law permits, we are not liable for indirect or consequential loss, loss of opportunity, loss of profit or loss of data, and our total liability for any claim arising out of the Service is limited to the amount you paid for Pro through the stores in the twelve months before the claim. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be excluded or limited by law.

Your responsibility to us#

If you use the Service in breach of these terms, and that causes a third-party claim against us, you will, to the extent the law permits, cover our reasonable losses from that breach. This does not apply to consumers where the law does not allow it.

Governing law and disputes#

Disputes about these terms or the Service are handled under the applicable law of the place where the operator is registered, and by the courts that have jurisdiction there. If you are a consumer, you also keep the mandatory consumer protections of the country where you live, and you may bring a claim in the courts of that country where the law gives you that right. Please contact us first at support@magicinterview.app so we can try to resolve it.

Changes to these terms#

We may update these terms. The date at the top of the page shows when they were last updated. If a change is material, we will tell you in the app or by email before it takes effect. If you continue to use the Service after the change takes effect, you accept the new terms. If you do not agree, you can delete your account.
